TERMS OF SERVICE
Last updated: 26 August 2026
Welcome to Hensky Thurs.
These Terms of Service (“Terms”) govern your access to and use of HenskyThurs.store (“Website”) and your purchase of products offered through the Website.
Throughout these Terms, the words “Hensky Thurs”, “we”, “us” and “our” refer to Hensky Thurs.
By accessing our Website, creating an account, placing an order or otherwise using our services, you agree to these Terms.
Please read them carefully before using the Website.
Nothing in these Terms excludes, restricts or modifies any rights or remedies that cannot legally be excluded, restricted or modified under the Australian Consumer Law, contained in Schedule 2 of the Competition and Consumer Act 2010 (Cth), or any other applicable Australian law.
1. About Hensky Thurs
Hensky Thurs is an online retailer offering men's fashion, clothing, accessories and related products to customers in Australia.
Website: HenskyThurs.store
Customer support: support@HenskyThurs.store
2. Eligibility to Use the Website
By placing an order through our Website, you confirm that:
-
you have legal capacity to enter into a binding contract; or
-
if you are under 18 years of age, you have obtained permission from a parent or legal guardian where required.
You must provide accurate, complete and current information when placing an order.
You must not use the Website for any unlawful or fraudulent purpose.
3. Electronic Transactions
You acknowledge that transactions, notices, order confirmations and other communications between you and Hensky Thurs may occur electronically.
Electronic communications and contracts may have legal effect in accordance with applicable Australian electronic transactions legislation.
Your use of electronic checkout systems, payment systems and other electronic methods may constitute your acceptance of relevant contractual terms.
4. Products and Product Information
We aim to provide accurate descriptions, photographs, measurements, colours, specifications and other information relating to our products.
However, minor variations may occur, including variations resulting from:
-
screen or device settings;
-
lighting used in photography;
-
manufacturing processes;
-
fabric characteristics;
-
production batches; or
-
reasonable differences in colour or texture.
Nothing in this section permits us to supply goods that are materially different from their description or otherwise fail to comply with the consumer guarantees under the Australian Consumer Law.
5. Product Availability
All products are subject to availability.
Placing a product in your shopping cart does not reserve that product.
In rare circumstances, a product may become unavailable after an order has been submitted.
If we cannot supply a product you have ordered, we will notify you and provide an appropriate solution, which may include:
-
cancelling the affected product;
-
offering an alternative product with your agreement; or
-
issuing a refund for the amount paid for the unavailable product.
We will not substitute a materially different product without your agreement.
6. Orders
When you submit an order through our Website, you are making an offer to purchase the products shown in your order.
An automated order acknowledgement confirms that we have received your order but does not necessarily mean that your order has been accepted.
Unless otherwise required by law, we may accept your order when we send you confirmation that your order has been approved or dispatched.
Once accepted, a contract for the purchase of the relevant products is formed between you and Hensky Thurs.
7. Right to Refuse or Cancel an Order
We may refuse or cancel an order where reasonably necessary, including where:
-
a product is unavailable;
-
there is an obvious pricing or product information error;
-
payment cannot be authorised;
-
we reasonably suspect fraud or unauthorised activity;
-
there is evidence of misuse of a promotion;
-
delivery to the supplied address is not reasonably possible; or
-
accepting the order would breach applicable law.
If we cancel an order after payment has been received and you are entitled to a refund, we will refund the relevant amount to the original payment method as soon as reasonably practicable.
We will not cancel an accepted order arbitrarily where doing so would breach your rights under Australian law.
8. Prices
Unless otherwise stated, prices displayed on our Website are shown in Australian dollars (AUD).
Where required by Australian law, displayed prices include applicable GST and other taxes, duties or unavoidable charges that must be included in the advertised total price.
Any delivery charges or optional charges that apply to your order will be disclosed during checkout before you submit the order.
9. Pricing Errors
We make reasonable efforts to ensure that pricing information is accurate.
Occasionally, an obvious typographical, technical or system error may result in an incorrect price being displayed.
Where an obvious pricing error occurs, we may contact you before fulfilling the order and give you the opportunity to purchase the product at the correct price or cancel the affected item.
Where we cancel an affected order after payment has been taken, we will refund the amount paid.
Nothing in this section limits any rights you may have under the Australian Consumer Law, including rights relating to misleading representations or displayed prices.
10. Payments
Available payment methods will be displayed during checkout.
By submitting payment information, you confirm that you are authorised to use the selected payment method.
Payment may be processed by third-party payment providers.
We do not guarantee that every payment method will always be available.
Your use of a third-party payment provider may also be subject to that provider's terms and privacy practices.
11. Payment Security
We take reasonable steps to use reputable payment systems and security measures appropriate for online transactions.
However, no method of internet transmission or electronic storage can be guaranteed to be completely secure.
Customers are responsible for protecting their own account credentials and payment information from unauthorised access.
Nothing in this section limits any obligation imposed on us by applicable Australian law.
12. Shipping and Delivery
Shipping options available to Australian customers will be displayed on our Website or during checkout.
Delivery information is also governed by our Shipping Policy, which forms part of these Terms.
Customers are responsible for providing a complete and accurate delivery address.
Any delivery estimate provided by us is an estimate unless expressly stated otherwise.
We will fulfil our obligations concerning delivery in accordance with applicable Australian law.
Where goods are not delivered within an agreed time, or within a reasonable time where no specific time was agreed, you may have rights and remedies under the Australian Consumer Law.
13. Incorrect Delivery Information
Please check your delivery information carefully before submitting an order.
If you discover an error, contact us as soon as possible at:
If an order has not yet been dispatched, we will make reasonable efforts to update the information.
Once an order has been dispatched, changes may not be possible.
Additional costs resulting solely from incorrect information provided by the customer may be payable by the customer where permitted by law.
This does not apply where the delivery problem was caused by Hensky Thurs or where Australian law provides otherwise.
14. Risk and Ownership
To the extent permitted by law, risk in physical goods generally passes to you when the goods are delivered to you or to a person authorised by you to receive them.
Ownership of products generally passes once full payment has been received and the products have been supplied to you.
Nothing in this section affects any statutory rights concerning loss, damage or delivery of goods.
15. Australian Consumer Guarantees
Products sold by Hensky Thurs come with guarantees that cannot be excluded under the Australian Consumer Law.
Depending on the circumstances, goods must:
-
be of acceptable quality;
-
be fit for any disclosed purpose;
-
match their description;
-
match any applicable sample or demonstration model;
-
come with clear title;
-
provide undisturbed possession;
-
be free from undisclosed securities or charges; and
-
comply with applicable express warranties.
These rights apply automatically and are separate from any voluntary warranty, return policy or guarantee offered by Hensky Thurs.
16. Faulty Products
If a product does not comply with a consumer guarantee, you may be entitled to a remedy under the Australian Consumer Law.
Depending on the nature of the failure, available remedies may include:
-
repair;
-
replacement;
-
refund;
-
cancellation; or
-
compensation for reasonably foreseeable loss or damage.
For major failures, you may have the right to choose a refund or replacement.
Nothing in these Terms is intended to limit these rights.
17. Returns, Refunds and Exchanges
Returns, refunds and exchanges are governed by our Return & Refund Policy, which should be read together with these Terms.
Our voluntary change of mind policy is additional to your statutory rights.
Any time limit or condition imposed on a voluntary change of mind return does not impose a time limit on rights relating to faulty goods under the Australian Consumer Law.
18. Change of Mind
Australian Consumer Law does not generally require a business to provide a refund simply because a customer changes their mind.
However, Hensky Thurs voluntarily provides change of mind returns in accordance with the conditions stated in our Return & Refund Policy.
Our voluntary policy does not affect your statutory consumer rights.
19. Promotions and Discount Codes
From time to time, we may offer:
-
promotional codes;
-
discounts;
-
sales;
-
special offers;
-
bundles; or
-
other promotional campaigns.
Additional conditions may apply to individual promotions.
Any material conditions will be made reasonably clear to customers.
Unless otherwise stated:
-
promotions cannot be redeemed for cash;
-
only one promotional code may be used per order;
-
discount codes may have eligibility requirements; and
-
promotions may be subject to stock availability.
Promotional conditions do not remove any rights available under Australian law.
20. Gift Cards and Store Credit
Where gift cards or store credits are offered, additional terms may apply.
Any gift card expiry period will comply with applicable Australian law.
Store credit will not be provided instead of a monetary refund where you are legally entitled to receive a monetary refund and do not agree to store credit.
21. Accounts
Where customer accounts are available, you are responsible for maintaining the confidentiality of your account credentials.
You should notify us promptly if you reasonably suspect that your account has been accessed without authorisation.
You are responsible for ensuring that information associated with your account remains accurate and current.
22. Acceptable Use
You must not use the Website:
-
for unlawful purposes;
-
to commit or facilitate fraud;
-
to interfere with the operation or security of the Website;
-
to introduce malicious code, viruses or harmful software;
-
to attempt unauthorised access to our systems;
-
to scrape or systematically extract Website content without permission where prohibited by law;
-
to impersonate another person;
-
to provide deliberately false information;
-
to infringe intellectual property rights; or
-
to engage in conduct that breaches applicable law.
23. Intellectual Property
Unless otherwise stated, the Website and its content, including:
-
brand names;
-
logos;
-
graphics;
-
photographs;
-
product imagery;
-
text;
-
layout;
-
designs;
-
videos; and
-
other materials
are owned by, licensed to or lawfully used by Hensky Thurs and are protected by applicable intellectual property laws.
You may access and use the Website for personal, non-commercial shopping purposes.
Nothing in these Terms transfers ownership of our intellectual property to you.
24. Hensky Thurs Brand
The name Hensky Thurs, associated branding, logos and visual identity may not be reproduced or commercially used without appropriate permission, except where permitted by law.
25. User Content and Reviews
Where our Website permits customers to submit reviews, photographs, comments or other content, you must ensure that your content:
-
is truthful to the best of your knowledge;
-
relates to your genuine experience where represented as a customer review;
-
does not unlawfully infringe another person's rights;
-
is not defamatory or unlawful;
-
does not contain malicious software; and
-
does not contain fraudulent or deliberately misleading information.
We will not manipulate customer reviews in a manner that would mislead consumers.
We may moderate content where reasonably necessary to comply with law, protect legitimate rights or maintain the operation of the Website.
26. Third-Party Links
Our Website may contain links to websites operated by third parties.
A link does not necessarily mean that Hensky Thurs endorses or controls the third-party website.
Third-party websites are generally governed by their own terms and privacy policies.
We are not responsible for third-party conduct to the extent that responsibility may lawfully be excluded.
Nothing in this section excludes liability that cannot be excluded under Australian law.
27. Third-Party Services
Certain Website functions may be provided through third-party service providers, including:
-
payment processors;
-
delivery providers;
-
analytics providers;
-
website hosting providers; and
-
customer service technology providers.
Our use of third-party providers does not remove any responsibility Hensky Thurs has to customers under applicable Australian law.
28. Website Availability
We aim to keep the Website available and operating correctly.
However, temporary interruptions may occur because of:
-
maintenance;
-
system updates;
-
internet outages;
-
cybersecurity incidents;
-
third-party service failures; or
-
circumstances outside our reasonable control.
We may temporarily suspend parts of the Website where reasonably necessary.
Nothing in this section affects obligations concerning orders already accepted or statutory rights available to customers.
29. Errors and Omissions
The Website may occasionally contain typographical, technical or administrative errors.
Where we identify an error, we may correct information on the Website.
Changes to Website information will not retrospectively remove rights that have already arisen under an accepted order or applicable law.
30. Privacy
Personal information collected through our Website is handled in accordance with our Privacy Policy and applicable Australian privacy law.
Please review our Privacy Policy for information about how we collect, use, disclose and protect personal information.
31. Marketing Communications
Where you choose to receive promotional emails or other electronic marketing communications from us, we will handle those communications in accordance with applicable Australian law.
You may unsubscribe from marketing communications using the unsubscribe mechanism included in our messages or by contacting us.
Transactional communications relating to an order, payment, delivery, security issue or customer service request may still be sent where reasonably necessary.
32. Consumer Law and Limitation of Liability
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right, remedy or liability where doing so would be unlawful.
To the extent permitted by law, Hensky Thurs is not responsible for loss or damage that:
-
was not reasonably foreseeable;
-
was caused by your unlawful conduct;
-
was caused by your misuse of a product contrary to clear instructions; or
-
resulted from circumstances for which Hensky Thurs is not legally responsible.
This limitation does not apply where liability cannot lawfully be excluded or limited.
33. Consequential Loss
Nothing in these Terms excludes a customer's right to recover reasonably foreseeable loss or damage where such recovery is available under the Australian Consumer Law or another applicable law.
Any exclusion of indirect or consequential loss applies only to the extent that such exclusion is lawful.
34. Indemnity
You are responsible for loss suffered by Hensky Thurs to the extent that the loss is directly caused by your unlawful use of the Website, fraud or deliberate infringement of our legal rights.
This provision does not make you responsible for loss caused by Hensky Thurs, its contractors or matters beyond your reasonable control, and applies only to the extent permitted by law.
35. Suspension or Termination of Website Access
We may restrict or suspend access to the Website where reasonably necessary because of:
-
unlawful activity;
-
fraud;
-
security threats;
-
serious misuse of the Website; or
-
material breaches of these Terms.
Termination or suspension of Website access does not remove rights or obligations relating to orders already formed, payments already made or rights arising under Australian law.
36. Force Majeure and Events Outside Our Control
Events outside our reasonable control may affect our ability to perform certain obligations.
Examples may include:
-
natural disasters;
-
severe weather;
-
transport disruptions;
-
industrial action;
-
governmental restrictions;
-
widespread telecommunications failures;
-
major cyber incidents; or
-
other events that could not reasonably have been prevented.
Where such an event affects an order, we will take reasonable steps to minimise the impact and communicate with affected customers.
This section does not remove any statutory rights you may have where products are not supplied within an agreed or reasonable time.
37. Changes to These Terms
We may update these Terms from time to time to reflect:
-
changes to our services;
-
changes to our Website;
-
operational requirements; or
-
changes in applicable law.
Updated Terms will apply prospectively from the date they are published unless otherwise required by law.
Changes will not retrospectively remove or reduce rights relating to orders already entered into.
The latest revision date will appear at the beginning of these Terms.
38. No Waiver of Consumer Rights
A failure or delay by Hensky Thurs in exercising a contractual right does not automatically waive that right.
Likewise, nothing done or omitted by Hensky Thurs waives any statutory rights belonging to a customer.
39. Severability
If any provision of these Terms is determined to be invalid, unlawful or unenforceable, that provision will apply only to the maximum extent permitted by law.
Where possible, the remaining provisions will continue to operate.
40. Entire Agreement
These Terms, together with policies expressly incorporated into them, constitute the terms governing your use of our Website and purchases from Hensky Thurs.
Relevant policies may include:
-
Return & Refund Policy;
-
Shipping Policy; and
-
Privacy Policy.
Nothing in this section excludes representations, guarantees, rights or remedies that cannot lawfully be excluded.
41. Governing Law
These Terms are governed by applicable laws of the Commonwealth of Australia and the laws applicable in the Australian State or Territory relevant to the transaction.
Nothing in these Terms is intended to restrict a consumer's right to bring a claim before a court, tribunal or other body with jurisdiction under applicable Australian law.
42. Dispute Resolution
If you have a concern relating to an order, product or our services, we encourage you to contact us first so that we can attempt to resolve the matter promptly.
Contact:
We will make reasonable efforts to resolve complaints fairly and in accordance with Australian law.
Nothing in this section prevents you from exercising any right to contact:
-
a State or Territory consumer protection agency;
-
the Australian Competition and Consumer Commission where appropriate;
-
a tribunal;
-
a court; or
-
another competent authority.
43. Australian Consumer Law Prevails
If there is any inconsistency between these Terms and a mandatory right provided by the Australian Consumer Law or another applicable Australian law, the mandatory legal right prevails.
These Terms must not be interpreted as excluding, restricting or modifying rights that cannot legally be excluded.
